Girl dies, brother critical in accident

Witnesses on I-26 say tire had problem, car skidded and hit trees

Helpless motorists watched Thursday afternoon as a burgundy sedan skidded off Interstate 26 and slammed into trees, the impact flinging two toddlers out of the car.

Authorities said a 3-year-old girl was killed and her 18-month-old brother was critically injured after being ejected from the vehicle in this one-car wreck Thursday on Interstate 26 near Ashley Phosphate Road. Emergency personnel tend to an adult injured in the accident.

Authorities said a 3-year-old girl was killed and her 18-month-old brother was critically injured after being ejected from the vehicle in this one-car wreck Thursday on Interstate 26 near Ashley Phosphate Road. Emergency personnel tend to an adult injured in the accident.

Ana Garcia-Millan, 3 1/2, died at Medical University Hospital a couple of hours after the 1:45 p.m. crash, Charleston County Deputy Coroner Kelly Myers said. The child's brother, 18 months old, was critically injured. His name wasn't released by the Charleston County Sheriff's Office, but a relative said he is known as Juan. He also was taken to Medical University Hospital.

Drivers told sheriff's deputies that something appeared to go wrong with a tire on the 1991 Oldsmobile Cutlass, which was heading east on I-26 between U.S. Highway 78 and Ashley Phosphate Road, Maj. John Clark said. It was unknown what caused the malfunction, but Clark said the tires were still inflated when deputies arrived.

The children's grandmother was driving and their mother was the front-seat passenger, Deputy Lee Girard said. He identified the grandmother as Maria C. Millan-Farusto, 42, and the mother as Delores Veronica Garcia-Millan, 22.

Their car was "pretty well torn apart," Clark said.

The Sheriff's Office will reconstruct the crash to answer several questions, such as the use of restraints and how the children were ejected.

Deputies found one car seat during the initial investigation, but Clark said it was unclear whether the children were properly restrained in child safety seats.

Nobody was home Thursday night at the grandmother's home in Sineath Estates Mobile Home Park off U.S. 78 in Ladson. Neighbor Belma Villegas said Ana and Juan were at the mobile home every day. Ana was sassy and liked to play dress-up, Villegas said. Her children wept as she spoke about the little girl.

Garcia-Millan's home in the Plantation Acres Mobile Home Park on U.S. Highway 78 in Ladson was dark, too, but there were signs that children play there — a pink toy car, a toy purple pony, buttons, dice and glittery stars.

The grandmother's family owns a restaurant, La Fortuna, on Loftis Road in Hanahan. About a dozen relatives gathered there Thursday night.

"I'm very sad and worried about the kids," said Juan Millan, the children's cousin.

Moonpie: It doesn't say if they were illegal, but it sure does seem like a lot of "Hispanics" have been losing their lives on our roads lately. Ashley Phosphate, I26, Redbank Road, Rhett......Whether they are crossing the streets by foot or by vehicle, they have been causing accidents all over the place.

A very sad story. I m not sure how a person could ever recover emotionally.
The Post Courier needs to stay away from this family. Riding by their house hoping to get a story is just sickening.

stupidity kills and i agree with moonpie.

my husband slows down when ever mexican drivers get near us they scare him to death. they speed cut you off and flip you off if you pass them. and they will ride up on your back him and clip your bumper then speed past before you can get their tag number or anything to id them

ship all of them back

use your head people children under 8 have to be in a car seat. over 5 use a booster with a back and the adult seat belt

these morons need to be charged with murder and child abuse those were babies and both were ejected which means neither was in a safety seat. irresponsibility kills protect the kids you make and deport these illegal morons we all know they were stats prove that 95 percent of all mexicans in this country are here illegally

IF, the children were not properly restrained it would be a horrible time left on earth for the mother and grandmother. The thought of losing a child because you didn't take the time to properly restrain would be hell on earth.

My condolences to the family. This is a horrible loss. Having said that, if the kids were not in the required safety restraints, the driver needs to be held accountable.

I haven't had any problems on the roads with Hispanics in general. In my experience, they drive very slowly, usually slower than the flow of traffic. The speed that they drive always makes me wonder if they are illegal and doing their best not to draw attention to themselves. I have had two of my employees involved in accidents with illegal aliens that did not have insurance or a driver’s license. In both cases, it was a simple bump in the rear at a stop sign.

People talking and/or texting on cell phones while driving pose a MUCH greater risk to my safety than a hispanic driver. I don’t think I’ve ever seen a Hispanic driver on a cell phone.

This is an extremely sad story. I can't imagine loosing a child, especially if it were my fault because I didn't restrain them in a car seat. My condolences to the family.

Not sure how this became an issue of illegal/legal mexican's though.

First, if the family owns a restaurant, it is unlikely they are here illegally. Second, there are bad Hispanic drivers and bad native-citizen drivers – I haven’t noticed a particular propensity for bad driving among Hispanics and I live in N. Charleston. If laws were broken (and by the facts as presented it appears they may well have been), punish the offenders to the extent the law allows.

My third point is a plea…

The deportation of illegal aliens seems to me to be a reasonable position. The rhetoric of its advocates, however, is making me rethink that position.

The words many advocates of deportation use scream so loudly I can no longer hear what they say. I hear increasing amounts of racist stereotyping (not overt racism – there is a difference) and dehumanizing rhetoric and it chills something in my soul. I have spoken with friends and I am not alone in my feelings.

Please, please think before you speak. The United States of America has long stood as a beacon of respect for human rights and the dignity of the individual. We aren’t perfect – there are blots on our record and our understanding has evolved and continues to evolve. But for the sake of Our Country, think before you speak.

i can not believe some of the comments on this blog. a person has lost their child or children! the only thing i hear is "send them back", "illegals". I guess you all think that if you see a hispanic then you automatically think the worst. i am so sick of this stuff in the low country. Racist azzez here are incredible. yes, we need a immigration bill or something but hispanics are the "new negroes" in the south. it is very sad state we are living in...... please just have something in your hearts other than hate. damn!

Satanssybil2007, while I agree that the mother should be held responsible, it is the driver of the vehicle that actually IS responsible, in the eyes of the law, for ensuring that occupants meet restraint requirements.

Wow what are yall reading! I thought the article said something about the vehicle's tire. I did not know her legal status or speed caused such a terrible accident. Thanks for pointing that out for me because this is what I read....

Show tact people one child is dead and another is trying to survive. Not every Hispanic you see is illegal especially ones that own a business.

if those children had BOTH been in proper car seats + restraints, they would have both remained in the car + quite possibly, uninjured.

i work with car seat safety every single day + know that if they were both in the correct car seat, this would be a different story. this means that both bases would have to be properly installed as well as for the children to be fastened in correctly. if they both were, they both would have remained in the car.

these two women, despite their grief, nationality, legality or anything else, should be charged with negligence in the death of the little girl + severe injury of the little boy. we are much too tolerant when these things happen.
it does not take a rocket scientist to know that driving is very dangerous (anywhere!) + to not follow basic guidelines for your child's safety is absolutely ridiculous + needs to be punished to the fullest extent.

This is totally heartbreaking.
Their legal status has nothing to do with this story.
These were two innocent babies, and one is gone.
Would the same comments be made if their last names were Smith or Gaillard?
Properly restraining your children is the responsibility of ALL people. I am sure that this family is suffering from the worst pain possible right now.
My thoughts and prayers go out to them all.

I can assure you that if you have ever had to package, load and work over a child to try save his/her life- you would not worry if the child in hispanic, black or purple--- here legally or not. A child's life was lost- thank god some of you don't work for fire/ems.

It is such a shame that a child had died and SOME people think it is a time to bash ethnic groups first I am pretty sure they are legal here they own a restaurant. Y’alls bigotry/prejudice is so overwhelmingly apparent this morning. You three have given me a headache.

As far as the grandmother and mother is concerned, if it is found that either one or both of the children weren’t properly restrained, then both of them should be held responsible for the death and injuries of the babies. If that isn’t the case then it was just a horrible accident like the tens of thousand of others that occur on American roads every year.

Regardless, the pain suffered by the immediate and extended family is very real. Losing a child is never expected or easy to deal with.

Instead of turning this tragedy into some sort of Anti Illegal Immigrant Political Rally, how about we all say a prayer for the family. Hopefully someone out there uses this as a cautionary tale about using appropriate child restraints when in a vehicle.

The tires were still inflated after the accident. That pretty much rules out the "tire problem" lie. I, sadly, suspect the the unrestrained victim and an unskilled driver had everything to do with this tragedy.

I don't know that you can say a faulty TIRE when they are still inflated when authorities arrive. The reconstruction has to happen to figure it all out.

If other drivers saw some wobbling or something of that nature, a problem with the WHEEL, it is most probable that the car has some front end suspension issue (tie rod end, CV joint, ball joint breakage, etc). Unfortunately, since many people do not differentiate between a TIRE and a WHEEL when they speak, it will take until after the reconstruction for folks to know exactly what, if anything, failed on the vehicle.

Please be more considerate of the Latino culture. If you went to these countries it is common for children to ride in the car standing. Also seatbelts for adults are usually not worn. They are just carrying on the traditions of their home country. We should be more understanding.

Such a tragedy. If only the children had been properly restrained. It sounds like the one child seat that they did have in the car was not even used.
As far as hateful rheteric, I see that more from the illegal aliens than from Americans. I see pictures of their protests telling us to go back to Europe and pictures of them burning our flag and flipping us off.
I am not saying these folks were illegal, just commenting on a few of the posts.
By the way, illegal is not a race.

I guess I took the tire thing too literally. It certainly could have been some other wheel-related mechanical failure. I am really just disillusioned about the evidence that there was only one child seat in the car. That's some real criminal negligence if I've ever seen it.

Since this ran, the little boy has since died. This story is the kind that makes you feel like throwing up. We know the family would do it over if they had the chance. And, painfully for them, they wont. Hind-sight is always 20/20. BUCKLE OUR BABIES UP PROPERLY, PEOPLE! When they are gone, that is it. We only get one chance to love them that much! My condolences to this family, and others who have lost a child along the way due to something that may have been avoidable.

You automatically assumed that these people were illegal aliens. Since their photos aren't posted I assumed you made that assumption solely based on their names. My point is that my name is Latin in origin and I asked you and your like minded cohorts if you would make the same assumption if my name was substituted for theirs. If it was I that was in that accident then you would be VERY wrong about my legal status. For not only am I natural born citizen, I am a decorated Army combat veteran. I couldn't be a better American citizen if I tried. Yet you would have labeled me an ‘ILLEGAL’. Your supposition is made of bigotry and prejudice and I called you and your like minded buddies out on it.

• Though most illegals are Hispanic, they are not all Mexican.
• Not all people with Hispanic names are Mexican.
• Other than committing the initial crime of coming across the border sans visa, most illegals don’t continue to commit crimes. Though there are many who do.
• Out of the illegal aliens living in the US only 65% are Hispanic the rest are Asian, Eastern European, Caribbean and African. There is also a small percentage of Caucasian aliens who live here under the radar after their initial visas expired

YOU PEOPLE, yes I said it, irritate me to know end. I wholeheartedly agree that there is a serious problem with the illegal aliens coming across the border en mass and those who come here legally and then overstay their welcome in order to take advantage of our way of life. Something MUST be done and done soon before our society develops ills that no legislation could cure.

But to use this article to spew your bigoted venom is low even for YOU PEOPLE.

Seat belts and car seats have not been the norm in this country for that long.

How many of you grew up with out either?

I remember riding with my Grandaddy while standing up on the seat and his truck had a metal dashboard!

Until it becmae the law here, most people didn't use any safety restraints for themselves or children. Now it is second nature.

eyfigueroa, I agree with your post all accept for one part. People that are here illegally do continue to commit crimes on a daily basis. They are usually here to work. They are working with out paying taxes. That is a crime. Many of them also drive to support working and they do so without a license or insurance.

I would never make the assumption that someone is here illegally based on their race... or their name. But if they are here illegally, they are committing crimes.

As I said earlier though, that whole conversation really has nothing to do with this article and I'm done with that part of the thread.

I agree with you on that. I remember riding in the front seat between my grandparents and never using a seatbelt, carseat, or booster seat when I was growing up. But that was when they knew how to build real cars. These toys they build today are not as safe as the ones we rode in 20 years ago. Like the commercial said, "It ain't your daddy's Olds Mobile!"

Personally I find it offensive no matter who may do it. I don't see too many hispanics on THIS BOARD making horrible assumptions about people with 'American' names. Actually quite the opposite.

"South Carolina state law requires that babies ride rear-facing in a federally approved car seat until they are at least one year old and weigh at least 20 pounds. Children ages 1 to 5 who weigh 20 to 40 pounds must ride in a car seat. South Carolina law further requires that children under age 6 who weigh 40 to 80 pounds must use a booster seat, and children under age 6 may not ride in the front vehicle seat, unless all rear seating positions are being used by other children, or the vehicle does not have rear seating."

If you know or have anything differently let me know but I got this from the SC DMV.

I was not making horrible assumptions merely commenting on photos I have seen of illegals marching in our streets burning our flag and carrying the flag of their country. That is not assuming. And yes, there are people in this country who hate our country and burn the flag.Wish they would move to another country since they hate ours so. I have been on other threads where some folks from south of the border were cussing and calling us names and saying they are taking our land back and telling us to go back to Europe. I view a person with an Hispanic name that was born here or came here legally and took the oath of citizenship as Americans. I don't view them as Hispanics. I hope they view themselves as Americans as well.

There is a corelation between the immigration status of these Hispanics and their driving habits. If you are willing to become a criminal by being here illegally (like most Hispanics), then you have NO respect for our laws one of which states that children MUST be restrained by either a car seat or seat belts. The mother and grandmother are 100% responsible for the death of these children because of their lack of respect for our laws. I hope they throw the book at them.

Coldbeer - There are citizens here every day who do not pay taxes. I still know people who do not work the typical 9 to 5 and get paid under the table. Yep, that still goes on. As for drivers having no insurance or license, I know a few of those folks too. I won't make the argument that these folks are right because they happen to be legal (citizen by pure accident of birth, meaning they did absolutely nothing to become a citizen but pop out of a birth canal) but I will make the argument that maybe we need to convince our own citizens to start obeying the laws in this manner as well (cue in Wesley Snipes). While I know that simply by being an "illegal" immigrant country means that you are breaking the law, I cannot and will not equate that with other crimes such as murder/rape/pedophilia etc. All crimes are NOT equal.

Oh, and I hope for everyone's sake that no one tries to equate my comments with some inane parallel of "illegal" immigrants and crimes. Lets not do this today.

I agree with you The Mouth of the South. If the car had gone the other direction, they could have killed other people as well. Some of the folks from south of the border have never even driven before and come here and get a car and drive. I do wonder how many illegals bother to have their car checked for problems and repairs as well. I for the life of me cannot understand why these precious children were not buckled in.

FYI many of the illegal aliens have obtained a legitimate tax ID number and do pay income taxes. This was one of the mechanisms set up to legalize the illegal aliens in the 80's/90's.

can someone explain how you can get an employee tax number with out proof of who you are? when I got one I had to show SS card and picture ID as well as proof of workman's comp if I was to have employees. of course that was 10 years ago things may have changed

Here is a link to the IRS fact sheet on ITINs (Individual Taxpayer Identification Numbers). It is noted on the page that receiving an ITIN doesn't change one's immigration statutus and doesn't allow one to work legally here.

Jane, I agree with you that the mom and grandmom should be prosecuted to the full extent of the law if the facts stated in the article are accurate.

The bigotry many are commenting on is taking this tragedy and making assumptions about the family's legal status and making blanket statements about how all illegals/Hispanics are bad drivers and lawbreakers and horrible parents.

It is the linkage from one tragedy to one whole group of people that have the same attributes as any other group of people - there are caring, law-abiding (except for lack of documentation)illegal aliens and there are horrible, law-breaking citizens.

Allwoman: Jane is in serious denial about how her comments are being perceived. She, like several others, made blatant assumptions about a family based solely on their last names. If I hadn’t mentioned my legal status, she would have assumed the same of me.

Apparently having a Hispanic name automatically assumes the negative and not anything positive. Apparently most Hispanics are Mexicans and thereby more than likely here in the United States illegally. Moreover, Hispanics are by far more likely to commit crimes. If my mind was as equally clouded by prejudice I guess her logic would absolutely seem solid to me.

However, such is not the case. She’s watches news bites, reads a few blogs and now everyone with tan skin, dark hair, Hispanic last name is suspect. Lord help them if they have an accent!

Instead of trying to liberate her and the others from these obviously deep-rooted prejudices I will instead will offer up a prayer to the Creator. A prayer that through their zeal of American Patriotism that they not lose sight of the fact that not ALL of us are criminals to be maligned on some terribly written newspaper article comments section.

As many have said before, these women’s citizenship status notwithstanding, if they did not secure those babies in that car then they need to be held responsible for their deaths. Cut and dry. Pure and simple.

I feel grief for the family and mourn the loss of these children and pray the family will find peace.

Also, if the facts above are accurate, and the mom/grandmother have broken laws they will face judgement in the justice system, which is appropriate. A person is obligated to follow the laws of the country they are in.

Once again, I am in total agreement with you. That is why I said that it is not the end. I know I have said some things about the illegal immigration issue but I try not to make an assumption about all Hispanic people or their "culture". If I do, I try to correct my statement and way of thinking as quickly as I can.

It is terribly sad that people can have that much deep-seated hatred or dislike for an entire group of people based solely on their race/ethnicity. And then they justify it by spouting statistics and, like you said, sound bites from the news.

I will pray right along with you, Ey, that those with bigoted views (whether they realize it or not) will try to see people for who they are and not for their last name, skin color, ethnicity, etc!!!

Not being a "regular" on here I do read a lot of the posts without commenting but I couldn't pass up my chance to weigh in. When did this become about "illegal aliens"? People are ASSUMING information when there is nothing out there to back it up. Unless someone knows something I don't. The point is that one probably two children are dead because of safety precautions. Being a mother myself, I can't imagine an existance without my daughter. Surely being "legal" or
"illegal" doesn't change that. Of course I am upset about the "illegal" problem as you call it. However, what this is about is failure to protect those innocent children that we are charged with taking care of by doing things like putting them in a car seat. Personally when I get home tonight I will hug my daughter and thank God for another day I have with her.

girly the info you posted up there somewhere is the same i have too. those precious angels should have been in car seats with five point harnesses. i couldnt imagine putting my 5 year old into the car with out him being in his booster seat. those seats are to save lives

I can't wait until that happens. You want cheap food stuffs? You'll keep getting illegals. Ask the US gubmint about bringing illegals in over the years start before most of were born. It happened during WWII because nobody could work the fields. Until we actually are willing to do something about it, i.e. willing to pay more for foods and services, actually enforce the ample immigration laws on the books, work to assimilate them, they aren't going away anytime soon.

It depends on which bogey man the local media outlets choose to highlight that particular month/week. The deadbeat dad section is always full of white and black folk. Go look around the state sex offender site and give me percentage then. Because they are of latin origin, it appears we know which bogey man you and others fear. Never mind people are dead and your concern is one hit your car/shopping cart or whatever.

Some feign concern for these children than proceed to lecture on the wholesome righteousness of car seats and only those mesican people don't use them. What a bunch a bunch of self righteous blowhards.

People in this country, illegally or legally, break the law. It's unfortunate that people have to die whether they are legal or illegal.

I hit a shopping cart once, I think the FBI is still looking for me.

all we had was blue ford sedan i cant off hand remember what the stupid car was. damage is less than a hundred so not worth fighting very annoying though. these were young guys barely old enough to have licenses

This is great to see that even in a time of deep sorrow we can still find real ignorance in our society. Every racist person needs to remember that God only sees one color we are all the same to the almighty, that also does not like ugly.. This is a very loving and caring family. Now do they not only have to deal with a great loss of 2 wonderful young lives taken away so suddenly and tragic, they have to deal with comments from stupid people..
