Man might be ruled incompetent to stand trial

A man accused of shooting to death five members of his family inside their North Charleston mobile home, then sitting on his porch for hours afterward, could be ruled incompetent to stand trial.

Michael Anthony Simmons is accused of shooting to death his wife and her four children in the fall of 2006. The deaths stunned the community by the scope of the loss. All the children were between 6 and 16 years old.

Simmons' public defender said Wednesday that his client has gone through numerous mental health tests conducted on behalf of prosecutors and also by his defense team. All reached the conclusion that Simmons is mentally incapable of facing the five murder charges against him, he said.

"Every mental health professional that has looked at him has said he's not anywhere close to being competent to stand trial and will never be competent," defense attorney Beattie Butler said. "He is profoundly mentally ill."

Ninth Circuit Solicitor Scarlett Wilson agreed that the tests on Simmons' mental state were in agreement with their conclusions. But her office is not immediately ready to endorse all the findings, she said, in part, because Simmons' mental issues escalated after his arrest and while he was in jail.

An evaluation hearing is scheduled for Friday at the Charleston County Judicial Center in front of Circuit Judge Kristi Harrington.

If Simmons is ruled mentally unfit, he likely will be transferred to a state mental hospital indefinitely. Additional tests also could be ordered.

The killings were among the most heinous reported during 2006, a record-setting year for murders in the tri-county area. North Charleston police found all five victims fatally shot in their Ferndale area mobile home on a Saturday afternoon. Investigators think Simmons, 41 at the time of his arrest, shot the family in the early morning. Neighbors reported seeing him sitting on his porch for much of the day, almost until the very moment police arrived. Some said he looked fidgety.

Killed were Simmons' wife, Detra Rainey, 39; and her children William Lee Rainey, 16; Hakiem Rainey, 13; Malachi Robinson, 8; and Samenia Robinson, 6.

The family had lived at the home at 1933 Marson St. for about four months after moving from West Ashley. Police discovered the victims after an unidentified witness tipped authorities off to the bodies, arrest affidavits said. Simmons was arrested as he tried to drive away from the area.

State Law Enforcement Division records indicate Simmons had a violent past. He was convicted in 1988 of armed robbery, assault and battery with intent to kill and second-degree burglary.

Detra Rainey's family earlier reported that she had grown up in the Orleans Woods section of West Ashley and worked in the cleaning department at Roper Hospital. She had attended classes at Beta Tech until an illness became too severe. She suffered from colon cancer. The couple had celebrated their first wedding anniversary just weeks prior to the incident.

Since his arrest, Simmons has been housed in the county detention center.

Wow what a way to add insult to injury.

How dare they try to get this MURDEROUS SCUM BAG OFF in the KILLING of 5 people?

I knew they were going to play the insanity card; that is so lame and so is Murdering Michael Simmons.

I do pray that the Rainey family can get the results they are looking for in this horrible, heinous crime.

How do they do a mental test? Ask a few questions and if you can't answer them, you are mentally unfit? That just means they have no education and dumb as hell. Seems like he knew how to use a gun for armed robbery and murder. I say kill the SOB.

He was smart enough to know how to kill and he knew when he did it he would not get very far so why not wait on the cops.
I just don't bye the "temporary insanity" plea. Either you're insane forever or not insane at all. Lack of education and ignorance is not insanity.

I remember this case, it was a sad story. People can "play crazy", why waste our taxpayers dollars to run comprehensive mental testing on this jerk? He was of sound mind to get in a car and try to drive away, correct?

Let's see here; he was sane enough to get married, sane enough to celebrate his 1st wedding anniversary, sane enough to own and operate a vehicle but after he kills some people, he is automatically crazy. He will be back on the streets in less than two years.

Keep letting them out dumbasses, they will continue to do crime!
An anonymous tip told police. Let me just ask, you hear five gun shots in the wee hours of the morning and later that day you leave an anonymous tip? Great neighborhood!

I taught one of the children. A very sweet child and a real shame what came of him. I was shaken for a long time at the loss of a student. What a sad story for the family and friends. I don't want to give the murderer any attention....he needs to suffer the same fate. You don't harm children!!!!!

Chances are they WONT execute him but he won't see the light of day ever again. If he is actually mentally ill, and there's a pretty good chances that he may be (personally I think anyone who kills their entire family with no apparent rhyme or reason definitely has some messed up stuff going on but whatever)they will probably confine him for life in one of the mental hospitals for criminals.

Very few people can accurate fake the buffers of mental illness examinations, they are usually sociopaths with extremely high intelligence.

If he is NOT crazy...well then he will have to suffer the rest of his days as the only sane person around a bunch of crazies. That won't exactly be the best way to go either...sounds like appropriate torture to me.

I use to see this man every Sunday at church. I remember him bringing William and Hakeem to catechism class on Saturdays. They were sweet boys, typical teenagers, not always paying attention when they should. Of course you can't blame them, the Episcopal catechism is pretty dry stuff at 15 and 16. I have pictures of all us going through Confirmation. I also remember during the sharing the peace part of Sunday service, little Samenia would come by to take a peek at my daughter who was then only a few months old.

I also remember feeling horrified that Sunday morning getting ready for church when we got the call that they had all been killed. And then sitting in church with the rest of my congregation who were also horrified and deeply hurt that these lives had been snuffed out so violently.

I don't believe that man is crazy, just a coward. How can you kill a child let alone the mother of those children that you claim to love. Detra and her children deserve justice. Those children were just babies who will never get a chance to grow up and have children of their own. That man doesn't deserve freedom least of all his life.

The insanity plea. This have been going on for so long. Why is it that so many people try using this plea every time they get into trouble. They know what they were doing before they committed the crime. People just don't just all of a sudden do a crime, they plan it. Fry this fool and it would be less on the tax payers.

Early...I agree with you, how can you kill a six year old, even if its not your child.

I couldn't agree with ya'll more. I can't stand it when these animals commit these violent crimes, and the bleeding hearts want to label them "mentally incompetent". Murder is murder, plain and simple. If our justice system would dole out the death penalty enough, I think the number of violent crimes would go down.

Girleygirl- Good Morning! do you really think he thinks that? Do you think any criminal thinks that is a possibility anymore? I mean, it should be, but it seems all to often these bstrds get off on a loop hole, or insanity plea, or some other kind of bs. Murder is heinous on it's own, but to murder a child.... let alone 4 children at one time, there is no punishment harsh enough for that.

lucy there is no connection between how many times we dole out the death penalty and a decrease in murder rate.

Many people who commit the most heinous murders, your charles mansons, jefrey dahmers....(insert any other name of a serial killer here) never receive the death penalty. More often that not it's usually one person who killed on other person. The death penalty isn't even doled out proportionally. A crazy mother drown all of her kids in the bathtub and death penalty isn't even considered. (Though I think the husband had a lot of responsibility there) I'm not saying it should be considered...I'm just saying they way it's even administered now is not proportional to the crimes.

I'm just not sure execution would deter the most heinous of crimes. Maybe your average drug dealer or addict, or crazy/deranged spouse that kills their spouse would care...but what about the people that are truly evil? Would the death penalty deter them? That's working with an assumption that everyone fears death, not everyone does. I tend to believe the most evil people don't.

Unfortunately, there is a lot of severe mental illness out there. I don't know if this reallt applies with this man, but in today's day, we need to look at the issue of building/expanding mental health prisons.

Tripsa, you're as bad as I am. As soon as I typed the words "severe mental illness" I thought "just ask the people who would rather fund terrorism by buying oil instead of drilling our own"

Didn't anyone know in 88 that the guy was crazy and a danger to society? If he was really mental, someone should have seen it while he was locked up before. Or, was he ever locked up? Now he's killed 5 people, who do we blame?

SCdeacinNYC- yes, perhaps you are right. Maybe the death penalty is not the answer in all cases. Maybe Jonesey's suggestion that the punishment fit the crime is better. All I'm saying, like most of the others here, is that if these people knew they were going to be held accountable for their actions and choices via HARSH punishment, maybe, just maybe, a few might have a change of thought.

A person can be declared insane, but it does not mean that they don't know the difference between right and wrong.
Jeffrey Dahmer was insane, but he knew he had done wrong.
Of course what he did was way worse than this guy, but killing innocent people is wrong no matter which way you look at it.
They have a whole battery of tests that they run these people through, but the problem is who can really say just how conclusive the results actually are.
People have been known to fool so called experts. It is a very difficult decision to decide if a person is competent or not. Just what determines competence?

If even the prosecutor agrees the guy is mentally unfit, why have him stand trial? Just put him away forever and be done with it. But get your emotions under control on here. If all you have done is read the news on this, you have no way of judging whether this guy even knows what he did. I especially love the comment about mentally incompetent people being useless to society so just kill them. Wow. EVOLVE.

How many violent crimes have been reported here in the last few weeks? How many played the "insane card" - it's not like we have everyone getting off on this. Doesn't sound like he just got an "expert" to testify, several doctors... and the DA agrees. If he is a sham, it will come out while he is locked up in a mental facility. Then, VOILA!, not having been tried already, he can stand trial.

Death row inmates who were later exonerated (by, say, DNA evidence) spent an average of almost 10 years from sentencing to exoneration.

I guess if we fry them quick enough...

There’s quite a few South Carolina inmates listed on Death Row that is currently housed at Gilliam Psychiatric Hospital awaiting their execution.

Tax dollars are well spent in these cases. It's the cost of having a society where we are reasonably safe from 1) criminals and 2) improper convictions. And coolfreak, everyone who ever sat on death row was found guilty beyond a reasonable doubt. Yet hundreds have later been found innocent. Some too late. How many is it okay for the state to wrongly kill so that you may save a buck?

Umm, I'm sorry but a teen seeing someone serve 20 to life for a crime is not going to think "oh gee maybe i shouldn't do that". You wanna know how I came up with that? Because that crap happens today and jackasses are still committing crimes (regardless of race raregar). BTK got life in prison and he bound, tortured and killed how many??????? Leave your race sh-- at home. Good grief. A normal adult human being understands consequences so it goes without saying that a person would know that if you killed 5 people your ass would go to prison. There is no death penalty or incarceration deterrent there. They ALREADY know that yet they do it anyway.

People who keep saying that he could have fooled a mental test, umm you are stretching it a bit. This fool is not Ted Bundy. He killed people point blank. He didn't sneak out of the bushes or kidnap anyone. He didn't have some elaborate scheme. He didn't even evade police for that long if I remember correctly. He looks dumb and even his eyes look crazy. Like my Mom used to say, it is all in the eyes. He is not some criminal genius so stop giving him more credit than he is worth.

Oh and I am personally against the death penalty but if a murderer is executed I am surely not saddened. Just don't give me any tripe about it being a deterrent. That crap does not fly with me.

MindBath - I have read about men who had been incarcerated for most of their lives just to be freed years later on DNA. Did you hear about the man who was in prison for a long time for murder and some attorneys KNEW he did not do it but neglected to tell anyone the truth because their client committed the crime. They could only bring it up after that filthy POS died. The guy is an older guy now. Two lawyers knew and said nothing. That one thoroughly pissed me off.

Test, Ted Bundy had a borderline genius IQ. He even served as a volunteer on a crisis hotline with noted true crime author, Ann Rule, and he had her fooled. She wrote the book "The Stranger Beside Me" that paints an exellent picture of how a person like this can fit into society and never be suspected as anything but an average guy.
He was a master at fooling people. His targets were basically college girls with brown hair parted down the middle. He killed many in Washington and Oregon, and he made the mistake of going to Florida where he was caught and later executed. They still don't know just how many girls that he killed, but the authorities are pretty sure that it was alot more than those for which he was prosecuted. He was very charismatic, had the looks of any normal person, and was very good at persuading young girls to trust him.
You just never know who may be a killer.

RTC - I read that about him too. I heard some people even refer to him as "good looking" too. I didn't see it but I guess beauty is in the eye of the beholder. He was very very disturbing.

Why were we not this outraged by the call girl who shot the man in her bedroom twice, that has yet to go to trial and may never make it to trial at all? Test, I agree, I didn't see where he was good looking either, just average. It just goes to show you that people don't have to look "weird" to be killers.
Hvae you read the books about Jeffrey Dahmer? He was definitely a nutcase, and his parents weren't much better.
I know some people might think that I'm weird, because I read these types of books, but I just like to try to figure out what makes these people tick.
I want to be knowledgeable about these people in order to be aware of the fact that anyone I meet could be one of them. I don't desire to be paranoid, but I hope to be able to identify certain behavior patterns in people for safety's sake.

This guy shot everybody in the house, then went outside and sat on the porch. I think if he was really crazy, he would have gone outside and shot everyone in sight until he ran out of ammo. I don't think crazy people can plan things that well. I also think keeping someone on death row for 20 years is not much of a deterrent. We can't afford to keep all these convicts on death row now and the number is rising. I need my money to buy gas.

He married (insane) and less than a year he kill wife and her kids. He's not crazy he has smart legal advice. Being in jail drove him crazy. I hope he gets use to it. Mental hospitals are no picnic either.

RTC - I have gone on the doe network (doenetwork.org) not out of morbid fascination but just to see if I have seen any of these people. I pay close attention to people missing or found in SC. I want to think that I could help somehow. There are women and men who are still considered "missing" because of Bundy and Dahmer. In fact I think all of you should check out www.doenetwork.org. There are people who are still considered missing. A lot of them I know are most likely dead b/c evidence pointed to someone but they couldn't hold them. There is a section called Unexplained disappearances and a section that has the likeness of unidentified bodies. I hate to think of the men, women and YES kids who still need to be identified. So no, I don't think it is weird.

Did you hear how the police actually stopped Dahmer (i think at a checkpoint) once when he had a body in the back seat of his car? He charmed the officer into letting him go. One of the sickest I've ever heard of is Gacy. Completely revolting.

Test, Yeah, Gacy wanted to start a new fashion statement. He was definitely a gross one. Remember how that poor Asian kid was running in the streets after he got away from Dahmer, and Milwaukee cops saw him and just laughed and called him another little f***ot. I was sickened by those woman that were yelling that they loved him when he was going into court. Now, that is weird!
Girley, Read John Douglas' books. "Mindhunters" and "Anyone You Want Me To Be" are good ones.
I am glad to see that other people share my same interests in books. I was starting to worry about myself. :)
Oh, and Test, thanks for the link. I will definitely check that out. If you know of any other good ones, please let me know.

Great comments, ColdBeer. I am in favor of the death penalty, and I don't think it is overused in heinous crime cases. However, the automatic appeal and the years that pass from verdict to execution need to be addressed. I wonder how many death penalty cases are actually overturned? And at what cost to the taxpayers?

This guy may be crazy now, but he knew what he was doing when he loaded the gun and emptied it into the bodies of his family. He knew what he was doing when he was "fidgeting". He knew what he was doing when he tried to leave the scene.

The bottom line is........he KNEW what he was doing. He has earned the death penalty.

I couldn't care less if he is sane or not! I do not want any person who would do something of this nature-knowingly or not- near me or my family, or anyone else for that matter. Hell, if he didn't know what he was doing, what's to stop him from doing it again? Who would want this animal living next to them? Some would say it is cruel to punish the mentally unfit. I say it is cruel to let them out and about to hurt others again. Susan Smith and Andrea Yates should be put to death immediately! No question! Family annihilators should be dealt with severely and swiftly.

Not too comfortable with the statement that, if mentally unfit, he would be put away in a state hospital "indefinitely." Why not "definitely" as in until he is fit to enter a regular prison for the rest of his life...

On another issue flowing about, we can never allow "swift" executions. Remember The Inquisition, The Salem Witch Trials, etc... I have read estimates that more than 1% of people on death row will eventually be cleared and released. This is based on stats from the last 20 years. That means there are some 30 people sitting on death row today for whom it will later be determined should be released. The death penalty will always be slow.

Even if it were quick, it is no deterrent. The Dahmers and Gacys and Bundys of the world will not be deterred. Nor will the family killers, most of which kill themselves anyway, just like school shooters. Nor the majority of the rest who think they will get away with it. Put them away for life with Truth in Sentencing (= No Parole) or sentence them to death and accept that appeals are necessary to assure the state never kills an innocent person.

I'd be hard pressed not to believe that SOMETHING isnt wrong with this man. He has that tell tale look in his eyes. He's not right, and it shows! Whether it's mental retardation, true insanity, or a personality disorder, I dont know, and THAT is the real question. If you're telling me he's not competent to stand trial because he's mentally retarded, that's a bunch of BS. He needs to be tried just as any of us would be. trainey35-i hate to say it but it will never end .my friend killer has been convicted for 13years and we still have to go to parole hearings and the memory of her will never die ,so the answer to your question is when god calls him home to face what he did here on earth that will be the true justice served... im sorry for your loss and keep praying he will get you through it!!!!!
