15-year-old charged with murder

Victim shot to death outside home

The Post and Courier

Adolphus Simmons, shooting victim.

Adolphus Simmons, shooting victim.

Victim shot to death outside home

A 15-year-old boy has been charged with murder in Monday night's shooting death of Adolphus Simmons at Bradford Apartments in North Charleston.

Police did not release the suspect's name because he is a juvenile, but they said he lived in the area of the apartments, which are on Bream Road near Dorchester Road at the head of the Evanston Estates community.

Spencer Pryor, North Charleston police public information officer, said the boy is in the custody of the state Department of Juvenile Justice.

Ninth Circuit Solicitor Scarlett Wilson said her office was waiting to receive more information about the case from police before deciding whether to ask that the youth be charged as an adult. Prosecutors have 10 days to make the request to a judge, who would have the ultimate say. If the judge were to agree, the case would be sent from Family Court to General Sessions.

Simmons, 18, who dressed as a woman and was doing freelance work as a hairstylist, was shot multiple times about 8 p.m. Monday when he took out his trash, witnesses said.

Pryor has said that investigators found nothing to suggest that Simmons' slaying was a hate crime. On Thursday, he said police were not releasing a motive for the killing.

Simmons' mother, Felicia Moultrie, said a group of people about two weeks ago had burst into the apartment where Simmons was staying, but Simmons was not home. "They were looking for him," she said.

Asked if police anticipate making additional arrests, Pryor said only that the case remains under investigation.

Moultrie said news of the arrest has helped her to deal somewhat with her son's death.

"It took a little pressure off me. I feel a little bit better today because of that news," Moultrie said. "Right now I need to know why. What triggered them to take my son away from me?"

In an unrelated case, a 14-year-old boy was convicted of murder last month in Family Court for the Aug. 11 shooting of Larry Thomas Jenkins of North Charleston.

The teen, who was not named because of his age, fired into a moving car on Constitution Avenue, killing Jenkins. He was sent to the Department of Juvenile Justice for a 45-day evaluation before sentencing. He could be sentenced to a juvenile facility until he is 21.

14 and 15 year olds committing murders. I’m glad they were caught and I hope they are both charged as adults. They don't need to be back on the street in three years.
Parenting! Parenting! Parenting! Parenting!

This is getting ridicules.

I want to move far, far away from here...I am disgusted that a 15 year old boy was able to get his hand on a gun, and had enough hate in his heart to gun down a man probably because he had a different lifestyle than his own. Where in the world are his parent(s)? Someone failed miserably, and I hope they find out where this punk got a gun.

Posted by mggoose2000 on January 25, 2008 at 6:16 a.m. (Suggest removal)

I know that we have a problem with young people having access to guns although I don't believe that having more laws restricting law abiding citizens from ownerhsip. What the majority of people are missing is that why would a kid 15 years old want to take someones' life?

SomeTruthPlease:
"Someone failed miserably, and I hope they find our where this punk got a gun".

We have all failed miserably; society has turned it's back on our children. We spoil them, bring them up in single parent homes, we are terrible role models. It all adds up to things like this.

We haven't gotten to the bottom of why yet, but no matter what the reason; children should not have so much hate in their hearts that they would want to kill!

AMEN to both of your comments. Try him as an adult and before the race baters get up, YES I said the same thing for the white kid from Mt P that decided it would be "fun" to hold up some places with a toy gun.
I'd like to see his(the killers)family tree posted here too. I bet Single mom raising more than just him in public housing somewhere??

I agree with some of your comments but not all. I don't think "we" have turned our backs on "our" children. I have not although I agree that many have. And, we have gotton to the bottom of the reasons. There are many. But, the biggest are teen pregnancy, a media gone wild, gangsta worship, single-parent homes, devaluing of education, and poor parenting.

I started to add poverty to this list but decided that poverty in and of itself doesn't have to be one of the contributing factors IF we have two parents who love their kids enough to raise them properly (say NO, you can't hang with so-an-so because they are bad, etc., etc., etc.,).

It's not hate in their hearts, it's false bravado and a lack of caring about anyone but themselves.

Posted by CADguy on January 25, 2008 at 8:04 a.m. (Suggest removal)

Since the mention of a group of individuals were looking for him, I am going to go out on a limb and say it was a gang initiation.

It is either a hate crime, retaliation on an advancement, gang initiation, or a status killing. There has to be a reason and these are my theories.

On the way to a record breaking year for murders.
Moonpie, what do you think the contributing factors are to the large amount of violence in Charleston and N. Charleston?

I'll bet this kid gets less time behind bars than the kid from Mt. Pleasant.

Posted by flinsc on January 25, 2008 at 8:28 a.m. (Suggest removal)

Early,
Lack of caring of people about themselves and others. A generational circle of growing up in a broken system that allows people to do nothing and contribute nothing to society. And lack or constant police presence in areas of crime and violence. Until those are fixed, then people will still behave in a way that we have seen the first part of the year.

Was Mr Simmons a licensed beautician, or was he conducting his business illegally? Was he paying taxes on his income?

Posted by charlene68 on January 25, 2008 at 8:37 a.m. (Suggest removal)

I just dont understand all the crime that is going on with these young people,, where are the parents? I also understand that parents have to work, especially if you are a single parent, but i do believe that appropriate arrangement should be made for your children,, i understand he is 15 and can stay by hiimself, but if there was the slightest bit of doubt or you have had rebellion problems from your teen , why would you trust them to be alone when you are working ? im not saying that is what happened here but obviously he was not under his parents control, and if he killed someone odds are he has been in problems of the sort before.. i have 3 grown kids and my son was the worlds worst with problems (thank god none with the law) but if i could not trust him to be good in school and do what he is supposed to,, Then i did not think twice about getting some family member to babysit him when I worked... It embarrased him so bad... but if you can not count on them to do what they are supposed to do in school or in the Public then how can you cant on them to do it when they are alone? especially if they have had behavioral problems in the past..... I dont know exactly how to expplain what im trying to say here.. but I hope this is a good Example. Im glad they caught him, but do think he should be tried as an adult .

Posted by uniequnough on January 25, 2008 at 8:49 a.m. (Suggest removal)

Just out of curiosity, Mon_Kie, What does him having a license to run his business, have to do with why he was gunned down? Do you think the 15yr old gunned him down becuase he wasn't paying taxes or because he may not have had a beautician license. I think that point is irrelevant.

mggoose2000,

don't group everyone into this as we failed miserably. There is a line drawn here on responsible parenting and non responsible. To say to the parents who raise there kids properly and produce outstanding citizens are in some way responsible for this is bs.

Early you are right, we are on a record pace in just the first month of the year. Who wants to bet another black male kills or is killed beforte the weekend is up?

Where did he get the gun. Probably from the stash that is missing from the double murder last week in which 30,000 dollars worth of stolen guns hit the street.

Did the mayor mention that last night when he was praising the chief and his worthless police officers? nope.

The article stated that the 14 yr-old convicted of murder last month was charged as a juvenile, and could be sentenced to a juvenile facility until age 21. That is 7 years for murder. A 16-yr old gets 10 years for armed robbery? Is there a big difference between age 14, 15, and 16. Why do 16 yr-olds get their pictures and names on the front page of the paper, but 14 & 15 yr-olds do not even have their name released. I don't care who you are, this is not justice.

Posted by Early on January 25, 2008 at 9:49 a.m. (Suggest removal)

nochasgirl, also ask the question on why the Gadsden boys who committed the same crime as the boys from Mt P haven’t even been charged in family court. This is an outrage and if I were one of the parents of these Mt P boys, I have a really good civil lawyer involved. Yes equality is very far from our community. What do think would happen if the tables were turned?

What does going to church and God have to do with a 15 yr old gunning dowing another person? Oh boy.....how many people have killed and still attended church and believed in God? Thousands!! Please spare us the "lack of spirituality" in a person life. Call a "spade a spade", this was a hate crime but it's sad that our state government thinks everybody loves one another until politics comes up. SC has no hate crime law because we still live in the dark ages of society.

“On the way to a record breaking year for murders.” Sad but true……..wait did I just agree with “EARLY”…I must be sleepy! Anyway, How many of us actually communicate (conversation not lecture) with these “needy” kids? How many just talk but show no actions? There is no excuse for shooting, but we can help rid this “anger/hate”.
Early….. What do you think the contributing factors are to the large amount of violence in Charleston and N. Charleston?

Early on your second post about Mt. P…I knew the real “EARLY” would show up ….I posted you back on this the other day but I guess you didn’t get it so here it is..
Mt. P vs. Other Guys...I posted "(who “are” guilty)"...and you come back with.. "let me get this straight, you say it’s Ok to rob". MAN!!! I thought you were just acting dumb..lol. They all are guilty! but Which scenario put more people in danger? That would make a larger sentence (sentence=jail time, not the one you write :)..... Now to the comment about my intelligence.....(view my comments to get the rest... sure you'll enjoy)

Poor kid never had a chance,Momma probably had gangsta rap playin around him since he was born, Stimulating his thought process into thinking that the lyrics in the songs are what life is all about. All he wanted to be all his life is a thug like those written in verse so he could be admired among his peers.

Posted by forget on January 25, 2008 at 11 a.m. (Suggest removal)

Like I said a couple of weeks ago, There are a whole generation of young people that are ruined. They have bought into this "thug life" and are trying to live this lifestyle. If you ask a dozen young men about 14 yrs old. what they want to be when they grow up, 9 out of 10 will answer a rapper. Shameful. When the "Gadsden 5" were being talked about, they mentioned 25 children between them. That right there is a major part of the problem. I'd like to ask how many different fathers they have. Then ask how many fathers are involved with their children. The lack of a family dynamic is the cause of most of this underage crime.
Someone said that they wanted to leave here, well, it isn't much different anywhere.

I wonder if the gun he used was one from the Burgess Collection that was missing after he was murdered last week?

You can't always blame single mothers or fathers, you never know why the person is a single-parent. There are MANY single parents out there that have control of what their kids are doing and where they are at. It has everything to do with parents in general that would rather the kid "be somewhere out of their hair" instead of being in their business. I married a single father, and my step son has always been well-behaved and out of trouble because his dad would not allow anything else. He decided to divorce his wife because she decided drugs was more important and didn't want his son to grow up in that kind of lifestyle. So, to say that ALL the problems are due to single parenting, is so far from the truth. I think it all goes back to the fact that the "Gov't" needs to stop putting in our childrens mind that if your parents "SPANK" you, then it is child abuse, and parents would stop being so scared of actually punishing their children for what they do wrong, then we would see a change. When I was a child, there was never such a huge problem as we often see now. TIMES HAVE CHANGED AND I THINK WE NEED TO GO BACK TO THE OLD SCHOOL!!!

If this is a black on black crime we need to get the Al Sharptons here to ask the blacks not to kill blacks and demand very severe punishment and throw in some reparations as they do when whiteys are involved in this sort of incident.

You're correct Tygers, not all single parents are raising children that are going to become a manace to society. I'm a single mother (had husband) and my child is honor roll, and involved in sports, etc. I don't accept bad behavior, and I don't make excuses for it. But alot of them blame everyone else for their and their children's shortcomings. Until they accept responsibility for their lives, and teach their children that they are responsible for their futures, it's never going to get better. School is there for them. Attend. Make an effort to learn something. They have to want to achieve something. The best way to do that is by example. They have learned the behavior from their parents. I have a feeling this is the start of a very bad couple of years for our young people. They have had this thug culture stuff thrown at them for a while, now they are putting it to use....
scary.

"What are you trying to say Mon_Kie?"

Was Mr Simmons a contributing member of society, or was he operating in the illegal underclass of Charleston?

If you are a law abiding citizen, who works at an honest job you do not end up associating with the criminal element. I worked at a job where there were benefits available for poor people. I had numerous clients come in wearing stylish fashions, gold necklaces, a bag full of fast food in one hand, and a cell phone in the other.

They also claimed to have little or no income.

This type of person thinks that they are getting over on everyone, but in reality they are associating with the criminal element, and there is inherent danger in such associations.

you can bet both parties contributed to this. I'm sure neither were upstanding citizens. Maybe if we are lucky they'll all kill each other off. the complex is nothing but a bunch of low lifes feeding off the goverment, breeding uncontrollably and smoking crack. Unfortunately the place is directly across the street from an elementary school. At one time the school, Goodwin Elementary was one of the best in Charleston County. But once your community is influxed with these people, they pull everything done. Why is it when everything turns black it turns to trash?

It is pathetic, but not surprising. Apparently a different strategy needs to be used to deter crime such as this from continuing to happen.

As for how to try the person, regardless of color anyone (I do not care if they are 5) who willingly kills another should be tried and sentenced as an ADULT! The only reason they wouldn't be is our artificial construct of what mandates child vs adult--and that has changed drastically over time.

The fact that some think they can do the crime, get punished as a juvenile, and have their records sealed when they are 18 only helps to increase the likelihood some will commit crimes--it is essentially punishment free in some cases.

DAMMIT!!!!!!!! WTF?!?!?!?!?!? I MEAN IT WTF?!?!?!?!??! ARE YOU FREAKING SERIOUS?!?!?!??! Scnative, mon_kie, and anyone else out there who wants to blame ‘the victim’: Let’s get this straight; you are blaming the victim for his own MURDER based on what evidence? His race? His choice of occupation? His address? His apparent sexual orientation? You made me sick. I try so diligently to enter into coherent and intelligent discourse with you people and there are times that your words sicken me to the point that I just refuse to respond. But for you two to have the unmitigated gall to call this young man a criminal and somehow ‘worthy’ of this sick violent act against him makes wonder what type of evil truly lies in your heart and soul.

Monkie: how do you know that these 2 individuals associated with one another? NEWS FRICKING FLASH!!!! Not all black people know or associate with another. Another NEWS FRICKING FLASH!!!! People are murdered everyday and many aren’t criminals or associate with criminals. Many are people just like you and me living their lives and simply end up victims.

Scnative: this young man was black and lived in an economically depressed, crime ridden area, and he deserves to die? I grew up in such an area and turned out wonderful. In fact based on your asinine, insipid, ignorant views you spout on this forum I’m going to assume that YOUR intelligence level is such that I’m FAR MORE financially, educationally, and career successful than you EVER hope to be. One day you or a loved will find themselves on their back on a gurney in need of emergency medical attention and you will look into the face of a black medical professional, and if you are man/woman enough, PLEASE PLEASE PLEASE say this to their face:

“PLEASE DON’T DO ANYTHING TO SAVE MY LIFE, IN CASE YOU DIDN’T KNOW, ANYTHING BLACK TURNS INTO TRASH TO INCLUDE THAT MEDICAL DEGREE/TRAINING OF YOURS”

Far be it for me to call you racist scnative, you’re just someone who has complete disdain for blacks and consider yourself and your race unequivocally & inherently superior to them.

back to the article at hand. at 15 i hope this person is tried as an adult. he won't get the death penalty due to his age but pulling a life sentence in the big house will hopefully bring some modicum of justice to Mr. Simmons' family.

she's just another angry black person looking to discharge her anger on white people. she's no better than the gansters that are out there killing each other. why are black people so angry?

Thank you scnative. Your rapier wit (sarcasm) has once again brought laughter to my otherwise nondescript day.

hmmm angry black person? There are several words in that statement that are incorrect but I won't quibble over semantics.

ONCE AGAIN, back to the story at hand. Is there anyone knowledgeable out there that knows if South Carolina has ‘hate crime’ statutes on the books? I know it’s black on black crime, but what if the motive for killing was homophobic in nature? I’m not a proponent of hate crime legislation, we shouldn’t legislate ‘thought’ only actions.

Someone else also brought up an excellent point, what if the crime was an attempt at some sort of gang initiation? I understand that gang infiltration in this state and especially in the low country has grown exponentially over the past decade.

I stopped responding to him a long time ago when he said blacks need to raise their children the "white" way. When I asked him what was the "white" way he never responded back. That told me I was dealing with someone that is not all there.

Allwoman- that was too funny and as much as I hate the stereotypes. But I understood why you said what you said and I got a kick out of it.

It is very likely that victim might be gay. I heard a report he was in a bar and asked some guy if he could push in his stool.

scnative: "why are black people so angry?"

The same reason white people eat each other!

Um, when did oral sex work it's way in to this???? :)

This may or may not be a hate crime. Maybe we'll find out when all of the facts are in. Personally, I'm against hate crime laws. Hate crime legislation basically says that one person's life is worth more than another. If someone shoots and kills me for my wallet, I would hope they could face the same punishment that someone gets for shooting a man because they think he's gay or of a certain race. ALL murders should be handled the same way. The guilty should be removed from the face of the earth.

Just saying... for "scnative"

This is a FORUM, not a BLOG

Google it, there's a difference.

It's too bad we can't execute this murderer thanks to our liberal Supreme Court.

DaOne...A physic is a medicine that purges...so...are you saying you are a medicine that purges?...thats interesting...and weird. Spell check.

Anyways...Ive said it before and I will say it again...BIRTH CONTROL! There needs to be some law passed that requires young girls to have a birth control like Mirena that lasts 5 years so that they cant go and have babies when they are still babies themselves. I bet this kids mom is 12-15 years older than he is. Who would seriously take their parent seriously if they were only 12-15 years older than they were? I wouldnt!

This is ridiculous. And crying racism is just pathetic. Maybe you should hold a press conference for these morons and tell them to quit feeding the stereotypes and making it difficult for you.

Posted by moonpie on January 25, 2008 at 6:12 p.m. (Suggest removal)

Early, I don't know what drives kids to do this. I really just don't understand it. While we here at the "post" don't always agreeas to why, we do agree this is a serious problem. And I'm baffled at how the black community leaders, political leaders, pastors and just plain ole us just stand by and watch for the most part. God help us is all I know to say, God help us!

eyfig- Is there anyone knowledgeable out there that knows if South Carolina has ‘hate crime’ statutes on the books?

Last I knew, SC was one of seven states that do not have hate crimes based on sexual orientation. I do believe they were getting ready to vote on one last year.

Posted by walleyedwoman1215 on January 25, 2008 at 8:07 p.m. (Suggest removal)

take a nap and kick rocks?! That was hilarious!
As for hate crime statutes, Google "Matthew Shepherd" and you should find a link to states that hav enacted that legislation...

No one is blaming the victim for the crime, but denying that victims do not ever make bad choices and put themselves in harms way is naive.

efy did you put and extra porterhouse on the grill for me? if you don't mind hanging out with a white dude...

take a mallet and beat some black pepper, chili pepper, garlic and mesquite marinade into it before you throw it on the grill and the whole neighborhood will be jealous

but I'm sure u have your own recipe as well

oh, about the article... my sincere condolences to the family, he really seemed like a nice person to me

unlike many of the others we hear about getting shot due to drug deals gone bad I think this was just bad luck, an opportunist behind a gun saw a chance he thought to get away with a heinous senseless crime that's cost someone's life that was loved in his area... what a shame what many are becoming

Posted by nochasgirl on January 25, 2008 at 11:45 p.m. (Suggest removal)

I believe that anyone who takes the life of another, does not understand the value of "life". And maybe the reason they do not understand that life is valuable, is that nobody has ever told them that "their" life is valuable. Can you imagine growing up without the love of a parent(s)? Can you imagine having nobody to care if you have been fed, if you came home, if you went to school? I think so many children who are born to "children" are suffering because there is absolutely no structure in their lives. It is a cycle that just repeats itself over and over and over. If you are a parent, whether or not you WANT to be a parent, do the RIGHT thing. Love your children. Discipline your children. Take care of your children. Break the cycle.

Early,
You , of all people, speak about being a man and “racist.” How comical? You know very little about being a MAN, but I credit you with being a true practitioner of racism. Do you realize that the nasty, racist things you have said in the past are still available to the public? How has anything those of us you label as “racists” compare to the things you have said? They do not. You have proven yourself to be a racist of the most blatant kind. It has only been lately that you have become a schizophrenic racist (one minute beating your chest about your superiority and inferiority of blacks-in particular, the next crying for unity). Your problem is you have an issue with anyone who proves to have a voice that is just as loud as yours. You are a true coward. One who attempts to bully anyone you perceive as less dominant. When you feel the need to label me, be a MAN and do it when you know I am able to immediately respond to your stupidity. If I am not on the forum, it is because I do not want to be involved. Anytime you wish to spar with me, let me know. I am always up for the challenge, my "racist" brother.
