Illegals in legislative cross hairs

House leaders plan tough measures; senators want constitutional convention

If the United States can't secure its border, state lawmakers say they will at least try to close South Carolina's to illegal immigrants.

But as the General Assembly reconvenes today, there are questions as to whether the members of the House and Senate can reach an accord — and keep the state out of court at the same time.

On Monday, House leadership outlined their plans to give the state one of the toughest anti-illegal immigration laws in the land. Meanwhile, senators have sent their own bill to the House and will push for a constitutional convention to give states the right to deny benefits to illegal immigrants and have them forced out of the country.

Advocates for immigrants say that amounts to the state attempting to legalize racial profiling.

Speaker Bobby Harrell and Majority Leader Jim Merrill said Monday that within a month the House will pass legislation to:

-- Force businesses with government contracts to verify the legal status of their workers.

-- Make it a felony to harbor, transport or shelter an illegal immigrant.

-- Bar illegal immigrants from attending any state college or university and make them ineligible for scholarships.

-- Stop illegal immigrants from benefitting from public programs funded by the state;

-- Punish cities and towns that ignore immigration laws and give sanctuary to undocumented workers.

-- Allow people fired by companies that employ illegal immigrants a civil right to sue.

"I've talked to a lot of South Carolinians, and they overwhelmingly say we need to do something about illegal aliens," Harrell said Monday. "Frankly, there are only so many things we can do on our own. But Congress has been unable to do anything. If we want to do something, we'll have to do it ourselves."

House Republicans also want the State Law Enforcement Division to contract with the federal government to enforce federal immigration laws — for a fee. The plan would also make magistrates consider a person's immigration status when setting bail.

Some of these ideas come from Oklahoma, which Harrell said has seen a decrease in the number of illegal immigrants since passing its bill. The state also has been subjected to a litany of lawsuits questioning the constitutionality of its laws.

So far, at least one of those lawsuits has been thrown out of court.

"We are not anti-immigrant," Merrill said. "We just want everybody to play by the rules."

Georgia is another state that has taken on the issue itself, and Harrell said that could force more illegal aliens into South Carolina if the state doesn't act first.

Some of these proposals have been passed by the House before, and they have languished in the Senate. Some senators say their own bill contains many of the same provisions that are on the edge of what is legal for the state to do.

"We could pass a lot of laws that would make good headlines in your newspapers, but they're going to do nothing but make some lawyers very happy," Senate President Pro Tem Glenn McConnell said. "We've got to be very careful so that we don't in the process have a lawyer employability act."

Diana Salazar, president of the Latino Association of Charleston, said the Legislature is trying to legalize racial profiling against people who handle the jobs no one else is doing. She said the economy would collapse without the help of undocumented workers.

And she called claims of 75,000 to 200,000 illegal immigrants in South Carolina costing the state $186 million a year (between $8,000 and $25,000 each) "a bunch of baloney."

"Those people don't get paid like you and I," Salazar said. "They pay into the system, but they don't file returns. What happens to that money?"

Salazar said that while it's true there are people illegally in the country, the discussion ought to be geared toward making them legal.

"These are real human beings," she said.

The other factor in what the state does this year is the Democrats, who say the Legislature will waste its time if Republicans do nothing but posture for votes. House Minority Leader Harry Ott, D-St. Matthews, said the Democratic priorities are education, health care and then immigration.

"The bottom line is we aren't delivering all of the services to the citizens that the citizens deserve," Ott said. "And we're spending way too much time up here trying to get re-elected."

Ultimately, McConnell said, the call for a constitutional convention or any legislation the General Assembly can pass will be little more than a bandage.

"We've got to get Washington to act," McConnell said.

JOHNQ is right sort of. I think this has been the govs take both federal and state, but not the people. They will do anything for the vote!
I blame these politicians for letting it get out of hand. There is no need to pass new laws just enforce whats on the book already. They do provide cheap labor and it is the ONLY reason a business will use them. I hear it heard all the time they work better, longer hrs, and their doing work americans will not. BS, who was doing these jobs before they arrived. They work longer hrs to make a decent paycheck because they get paid so little on the hr.
CAN YOU SAY SLAVE LABOR? WE HAVE A NEW CLASS OF PEOPLE.

Legal immigrants pass through a considerable process to be allowed in this great country such as health and background screening.
Illegals (fake immigrants) have no such control and therefore enter America through dishonest and covert means and further compound their felonies by stealing American's ID in order to dishonestly obtain cars, housing and, yes, welfare.
These people harbor criminal pasts, Hepatitis, Tuburculosis and other contageous illnesses common to the area from which they left.
They are hard working for meager pay because if they complain or stick out in any way there is a potential for arrest and return to their country of origin.
Meanwhile, American VETERANS are not able to find work or afford housing because some TREASONIST company can get cheap labor from illegals who cannot speak up because they have no right to employment in the first place.
Get real - commit treason against Americans by hiring illegals and go to prison.
You want cheap labor, grab a guy who is homeless and looks like hell because he lost his job to an illegal and now has to live on the streets and beg for crumbs.

The reason they don't file tax returns is because they are using yours and my SSN.

Native Son brought up a real problem, tuberculosis. Un-checked health problems are dangerous and TB spreads like wildfire.

I don't see a solution other than hard measures against criminal aliens. They brought this dissent upon themselves by not only refusing to assimilate into my country, but by turning my town into "Little Mexico". I should not see "gracias" on the door as I walk out of a convenience store.

As for you Salazar, why is it none of their advocates have a last name like Smith or Jones?

Wow. These guys aren't playing around--I'm impressed.

We have more than enough home-grown illiterate high-school dropouts to do the work done by illiterate high-school dropout illegal workers. Problem is the state and federal governments pay those people to stay home and watch TV, so they have no need or desire to work...

Why is it these "advocates" let their Hispanic name trump being an American?
Why do I have to continue to pay for illegals groceries? I continue to see non English speaking women whip out their WIC vouchers in Wal Mart.
Why do I have to pay for the delivery and prenatal care of their babies?
Why don't these construction companies go to the local highschools and set up an apprenticeship for kids who don't or can't afford to go on to college? This gives them a great skill and keeps them from going on the dole and it would make alot of illegals leave!

I heard recently, kind of as a joke, that the best way to secure our borders is to find an immigrant that was granted a green card, put him at the border, and tell him that the next illegal that manages to cross over gets the legal immigrant's green card, job, and financial security, and in turn he, the legal immigrant, gets deported for not stopping the illegal guy. At first I laughed, but now...

The tax money, where does it go? It doesn't go anywhere because it was not paid. Most are paid under the table for one, two, working around hospitals sometimes I always see Mexicans in the ER. An average ER trip is 5-8 thousand. Who pays for this? How many NC and Georgia tags do you see with a truck load of Mexicans in them, no property tax, who pays for that? Welfare without contributing to the system, who pays for that? Absolutely nothing against Mexicans but why is it that a lot of folks think it's OK to come in the country illegal?
Here's the deal: Deport illegal immigrants and make those capable of working, work for welfare.

These government officials need to go out on the jobsites, say around charleston, summerille and the shipyard on friday afternoon after the payroll has been given to the head mexican and watch how many of the superintendants have there hand out for the kickbacks being giving so that the illegals will have the job.

Thank you Bobby Harrell! Originally, I am from the Greenville, SC area. I was appalled at how the illegal immigration has taken over the northwestern area of Greenville (specifically, the Berea area for any of the other native's), but upon moving to Charleston, I quickly realized that this is a statewide crisis. Not dilemma, issue or problem - a crisis! It is time to quit being nice or afraid to hurt feelings. We aren't being racist, nor discrimitory - we just want our country back. I have no problem with immigration, but there are avenue's for obtaining citizenship, and these people are not taking advantage of those. And there is nothing wrong with being proud of your heritage, but at the same time - immigrants should somewhat reform to our culture as well, and this is not happening. They are paid in cash and what money isn't western unioned back to Mexico is spent at gas stations along Ashley Phosphate and "Taco's y Torta's" vans scattered around Charleston. So what taxes are being taken from these people? On the other hand, my mother is a teacher, and I know first hand that they don't mind sending their children to our school for a free education, or using our roads, hospitals and jails - but how much is really being contributed to our economic system? I just question the timing (in regards to elections on the horizon) of these new sanctions. This should have happened 10 years ago, before this problem ever took root in SC.

If they leave you won't be able to find a group of men to put up a deck or paint your house in one or two days. We will have to go back to the bubbas who don't show up on time and give you high bids.

The Mexican grocery stores will be hurt and so will the taco stands.

Taxes? Be glad they don't file taxes. Many of these men have children living here. If example the man was self employed and netted $20,000.00 a year and had one or two minor children living with him. The man would pay no income tax and would more than likley qualify for the federal earned income credit and child tax credit of approx $5,000.00 for two children. He would have to pay self employment tax approx $3,100.00. This would leave him with a refund check of approx $1,900.00. If he worked for W2 wages he may get back more money. Pretty sweet deal.

I get a kick out of these people that have more blood in their hearts than sense in their brains when they make comments about illegal aliens contributing to society and not getting anything in return. How does one contribute when you don't pay taxes and only take? I worked for a local company that unfortunately thought it was a "good investment" to hire illegal aliens. Trust me when I say they all took the maximum payroll deductions meaning they didn't pay a dime in taxes but they would brag that their kids got free/reduced lunches at school and their wife/girlfriend was getting WIC and food stamps. And of course I always loved getting those letters in the mail letting me know that our newest Senor's SSN was invalid but if we couldn't obtain proper documentation we could not legally terminate the employee for providing false documents. It appears to me that illegal aliens get a lot back on their investment. They're here illegally and we've bent over backwards and broken our own laws to hand them everything on a silver platter. There's something wrong with that picture.

I still find it amazing that I have to carry a passport when I travel overseas. Whether it be for business or pleasure, I get the 3rd degree when I try to re-enter MY country. I mean, sometimes it gets so out of hand that I wonder what it was that I left for in the first place. Yet these illegals jump a small ditch, cross a small sandbox, and then climb a small fence and they are home free. And guess what -- this ain't their home!

Some of these provisions are ridiculous.

An individual is suspected of being "illegal" is lying on the street injured or sick. So, it would be a felony for me to drive that individual to the hospital without verifying the citizenship status of that individual? Or do we use the new "paper bag" test; well, he or she "looked" illegal. Whatever happened to compassionate conservatism?

As long as the federal government does not exercise its responsibility to provide for the common defense, the state governments should fill this void. If they do not, then the counties should jump in. At some point, one may be required to protect ourselves. Do not look for any help from any of today's governments. They have convinced themselves that they must sit on the fence. So few vote who have a stake in this country, and yet too many vote who have no stake in anything but themselves.

I think when they are talking about it being a felony to transport, shelter, harbor an illegal whome, they referring to sneaking them into the country, across state lines, etc. That would include kidnappped girls being forced into sex slavery. You will not get into trouble for taking someone in for a medical emergency.

Seal the borders. Throw out all of the illegals. Get rid of the welfare system that we all complain is being abused. The natives who no longer have welfare will fight for the jobs that they now won't consider doing. Then you should make it easier for immigrants to enter the country legally.

In other words, fix the welfare system and immigration will fix itself.

I'm encouraged by the effort, but I still think this is treating the symptoms, rather than the disease. There wouldn't be so much work here for illegals if we didn't make it so expensive to hire an American and so lucrative for an American not to work. The term "jobs Americans won't do" wouldn't exist.

We are reaping what FDR and LBJ have sown and others have cultivated.

I just spoke with a guy that I work with a few minutes ago. He is of Brazilian decent, but has lived in the United States for most of his life, speaks perfect english, looks like an American and is here legally. He locked his keys in his car downtown this morning, and was trying to fish them out through his car window when a city officer rode by. They asked him what he was doing and he explained exactly what happened. His tag/vehicle is registered in Virginia, but he lives here. So the officer was asking him about where he is from and about his tag and so on. When asked, "where are you from?", he stated, "originally, Brazil". And upon that, they took him in until he could verify his status and the fact that the vehicle was his. He spent all day in police custody before the Virginia DMV could verify his vehicle and he could secure a copy of his paperwork. Why are officers riding around taking people in for "suspicion of being an illegal immigrant", but seem to care less about the tons of illegals that stand around on the side of Ashley Phosphate all day? Our system is a total mess and embarrassment.

The man asked to be obtained if he is riding around in his car with out of state tags and lives here. Unless he is in the military he needs to have a SC tag and drivers Lic if he lives in SC. This way the county can collect the property tax on the car.

NO public school is allowed to ask for proof of citizenship on any child.

I know this b/c my husband is currently an administrator in a local public school that has a significant enrollment of Hispanic students.

This all sounds great to me. Where do I sign. An illigal alien hit my wife on 526 and fled the scene. A good samaritan followed and got the license number. Car was regestered to a women in Mexico. Absolutley nothing happend to this Mexican that hit my wife and my insurance was forced to pay out for the repairs. I want my state back. I welcome all those who go through the legal process, learn the language and assimilate. To those who don't want to go through this process... you are not welcome.

GG - you are correct. As I said, my mother is a teacher and they require no documentation for enrollment. What hurts them is that the schools receive funding based on PACT test scores, and because alot of these children don't speak english, they score poorly and the school loses federal aid. And John S: He attends college in Va, but works for our company here in SC. And since when are you supposed to be detained for having an out of state license plate?? I've seen vehicles from every state in the country - and I've also seen British tags on vehicles, Canadian tags and the other day I saw a "Ford Mondeo" with a Mexican tag - I kid you not. They don't even sell those vehicles here; how can you drive one on our streets? Surely none of these vehicles pay SC property taxes. But, I digress - are the illegal's riding around on our streets paying taxes on their vehicles? I travel our streets every day and have yet to see even one detained.

The DMV does go down sometimes. But, I don't think the police are doing that just because of his race. I think they may have been making sure he wasn't stealing a car. Who know's, but if they ran his info, they would know if he is illegal. Illegals don't came back on the computer.

Great points everyone, here’s my perspective on the current immigration mess. I can only speak about what I see in our own city. Yes, illegal aliens are coming across our borders in alarming numbers and this takes a toll on our communities both financially and mentally. These people are making coming here in droves, heck this is “The Promise Land”, the land of opportunity and freedom. the one thing that brings these people here is Employment! How do we as a people, in a land of laws and rules, curtail this immigration problem? First, we need to go to straight to the root of the problem; we need to stop these greedy, selfish, lawbreaking employers from hiring these illegal and undocumented workers.

If we just focused on the employers, I think the problem will eventually resolve itself in due time. Just look what Dorchester county did to help curtail employers from hiring illegal, undocumented workers: http://www.dorchestercounty.net/docs/Ord... .

This Ordinance is like many others of many ordinances across the nation where local governments are attempting to fix the root of the problem. We have a problem with-in South Carolina state government and even our very own local governments they can’t pass judgment until they fix what’s or who is in their own back yard. If you’re not following what I am saying, just stop by one of many State, local government construction projects in the Charleston area, they use big time construction firms to do projects, but just look around the work site and count the latin help, and you'll be amazed. Sorry Senor, No Habla…

OK Stop, I know what your thinking, I'm profiling right? Well I'm not (heck my name is Juan), I'm just stating the plain facts and obvious truth. So let’s band together and insist our local government make rules and enforce them.

We need to stop these greedy developers, house builders, hotel builders, hotel housekeeping companies, road construction, utilities companies, janitor services companies and landscapers to name only a few. Insist that our local government create ordinance and laws to Stop employers and there shifty, profit driven way and hold them to the letter of the law.

‘a message to the bad employers… Hey dudes, Shame on you! Stop it! You are the reason they keep coming, you are the reason things are the way they are. Stop!!!

Do the right thing, hire legal workers, those who can pass the I-9 verification test.

It’s an easy fix, follow the rules, create local laws and ordinances, and after they rules are in place, most of all we need enforcement!

I agree with the posters who hold Lindsey Graham largely responsible for South Carolina's illegal immigrant woes. He has put out a welcome mat for them. They are encouraged by this fervent support of their illegal activities. His argument, along with cohort John McCain, that it is not amnesty because they have to pay a 'fine' is unmitigated crap. It doesn't matter what they try to name it; it's still amnesty and they can't be allowed to get away with such a sophomoric and absurd position. They should be booed every time they mention it.

PalmettoMan--for photos, try sitting in your car outside a Chinese buffet around supper time. On many occasions, I've seen a certain North Charleston plumbing company van pull up and disgorge anywhere from 6 to 8 Hispanics to eat at a local buffet. I don't know if they're legal or not, but what are the odds?

I'm a legal resident alien and will be going for my citizenship test next month. I've paid taxes all these years, (still do), volunteered copiously for nonprofits, and only took food stamps for six months of my decades in this country when my first husband left me and my small child for parts unknown.

What prompted me to become a citizen now? Two numbers: 9 and 11.

A major problem with illegals is "anchor babies"--any illegal's child born on US soil becomes an instant American and is eligibile for all benefits, including Medicaid, day care, kindergarten, and other entitlement programs. Britain changed its laws back in the 70s, I think it was, to prohibit citizenship unless at least one of the parents is British born. Ireland took the same route a few years ago. We should too, except I think we should offer citizenship to any alien willing to serve in the military and fight for our country. If they're not in a war zone, let illegals serve 8 years and then confer citizenship.

What really gets me going? The fact that most automatic telephone attendants give a choice of English or Spanish and then when you try to use the voice option, the damn thing doesn't understand an English accent, no matter how hard I try to say "can't" in American!

Seriously--illegal immigration is already costing taxpayers a great deal of money (google on it) and lack of assimilation is changing the culture and will continue to do so.

What will we do without illegal labor? Well, we'll have to build our decks and paint our houses ourselves, just like we used to before illegals came along and we grew lazy. I'll be painting the trim on our brick house this spring. If the deck needs repair, I'll do that too--maybe supervise a neighborhood lad if the knee joints are too creaky.

Anybody who sneaks across our border, bypassing the system and breaking our laws is a criminal. I no longer refer to them as "illegal aliens". They are "criminal aliens."

It's not a matter of racism. If we were up to our armpits with Lithuanians who snuck in, the emphasis would be on Lithuanians and not Hispanics. It's not a matter of where they came from, the issue is how they got here.

It is not racist to cite the FACT that most of them are from Mexico and Central America. I'm not singling them out per se, because I want the illegals, er, criminals, from Ireland, Haiti, Brazil, and every other place run out of here.

How many meanings can the word "illegal" have to politicians???

It is the Americans along with our ancestors who built the infrastructures that is now being given away to the illegal’s?

I have witnessed the 3 & 4 overflowing carts being pushed by the Senorita’s at the North Charleston Wal-Mart and then paying with the EBT cards. Once I saw a Senorita with a double baby cart, one child just old enough to walk and one on her hip.

Tell me gringo’s what American would travel to a foreign country and the first thing you would do is to start a litter?

I have seen the taco stands in North Charleston competing with restaurants, I am aware that the illegals are keeping the wage scales lowered to the point that American citizens to include African Americans have to compete with the 3rd world. How is this serving our citizens?

How many illegals have killed cops, African Americans and scammed our citizens? And yet those who we elected to protect us pander to these criminals. This is such a bizarre debate that should not even be debated. We have laws!

Our politicians [ poli = many + tic’s = blood suckers ] have chosen sides, and by their actions “or lack there of” it is becoming quite clear. They have turned their backs on Americans and our ancestors in favor of Jose, Maria and the litter.
