SUMMERVILLE — The State Election Commission will not hear more of the Republican Party's arguments against Bill Collins' petition candidacy for state Senate. But that doesn't mean the party's fight to keep him off the ballot is over. Collins, a former newspaper publisher, is running as an independent against lawyer Mike Rose, who beat state Sen. Randy Scott in the Republican primary for the District 38 seat. The GOP claimed that Collins' petition did not meet legal requirements in at least nine areas. The Election Commission heard the arguments last week and took no action, leaving Collins' on the Nov. 4 ballot. The GOP asked for another hearing. That won't happen, Chairman John Hudgens said in an Aug. 19 letter to Columbia attorney Karl (Butch) Bowers, who is representing the Republican Party. Hudgens said the commission has no legal authority to hear a protest concerning a petition but wanted to give concerned parties a chance to voice their objections. "Having concluded in the August 12 meeting that these issues did not merit changing the staff decision, the Election Commission declines to reconsider the staff decision concerning the matter," Hudgens said in the letter. Republicans are considering a legal appeal, Dorchester County GOP Chairman Arthur Bryngelson said Wednesday. "If we don't take this to court, it's going to be hanging in limbo," Bryngelson said. "We are setting a precedent here that will affect all future elections." Bowers, a former Election Commission chairman, said the commission declined to act partly because there is no legal precedent for appealing a petition. "They declined to hear our protest on procedural grounds," Bowers said. "I am confident they did not consider the merits of the case. We're examining all our options right now." Collins said he is not surprised the Election Commission dismissed the GOP's claims and is prepared to keep fighting to stay on the ballot. "I intend to do whatever it takes to see that the people's voice is heard and to protect the integrity of signing their petition," he said. "This is a country where freedom of speech is important." Hudgens also said in his letter that only a candidate can file protests. Rose was involved in writing or editing some of the legal briefs for the GOP, the electronic versions show him as the author of several, but he was not the one asking for a hearing. He did not return a phone message asking if he plans to protest the petition.

Rose has run out of appeals. He also shows he is not much of an attorney when the law says only the candidate can file an appeal and he bully's the Republican Party to do his appealing so he doesn't look like a complainer. But as Mr. Hudgeons' says, "only the candidate can file an appeal". COLLINS WILL WIN BY LANDSLIDE IN NOVEMBER.

This thing with trying to get Mr Collins off the ballet has been like passing an accident on the highway - I don't WANT to look, but sometimes I look, and then I feel nauseous and hate myself for exposing myself to that.

Who the F cares??? Mr. Rose's pockets must not be deep enough to stop this and obviously he fears the public. Another example of F'ing ridiculous. It's only 8:45 in the morning and a need an f'ing highball to get through this day. Thank goodness i don't pay for the damn paper!

Former state Sen. Mike Rose has been subpoenaed in the DUI trial of his June 10 primary opponent, state Sen. Randy Scott, but Rose said Tuesday that he hopes to quash the subpoena because he knows nothing about the case.
"I have absolutely no knowledge, none, of the circumstances of his arrest or his guilt or innocence other than what's been in the newspapers or on television," Rose said. "This is a political ploy on Scott's part to associate me with something I'm not associated with. His campaign is based on sympathy and untruths, while mine is based on substance and truth."

Nash gave a recording of a phone call Scott made to his wife from the jail to The Post and Courier after the newspaper requested it under the Freedom of Information Act. Jock Stender, a Mount Pleasant fraud examiner, also requested and received the tapes for his own information, he said Wednesday.

All of this is so sadly funny! I have been complaining, in writing and orally, to the State Election Commission for months about corruption to include Election Law violations in Berkeley County politics. I have a written letter signed by Chris Whitmire, Public Information Officer from the State Election Commission, and a lengthy telephone conversation where he stated that MOST election laws are NOT enforced and DON't carry any punishment for there violation. It's amazing to me that we elect and pay our legislators who make laws that are not enforceable or carry no punishment for there violation!! It appears we're just a notch above many third world countries!! We could save mega bucks by abolishing both the State Election Commission and the State Ethics Commission!

Mr. Collins: The "people's voice" was heard loud and clear in July, when Rose beat Scott in the primary. Perhaps you didn't like what you heard; that's your right. But from the outside, it looks like you've chosen a chickensh*t backdoor way to get on the ballot. If it was important to you to be elected to this Senate seat, you'd have run against Rose and Scott in the primary. Obviously, it wasn't.
John S. and others who continue to claim that Rose is "afraid" to run against an opponent: He already did, and he beat that opponent "straight up," to use your words. The fact that Collins didn't like the results is his own personal problem. As a taxpayer, I'm furious that we're going to have to go to the expense of staging another election to satisfy the whiny-butt voters who are mad that their candidate didn't win. That's what happens in an election; someone wins, someone loses, and life goes on.

my question is this: Is Collins a Republican or not? Because if he is, he had his chance to run. He chose not to run. If he is a libertarian or a green, then go right ahead and run. But if he is running and then will join the GOP if he wins, I call BS on it.

You do know that the election between Collins and Scott is going to be a part of the general election, which was going to happen whether Collins entered the race or not. No extra expense there.
And the primary is only used to select a certain party's candidate for the general election. Collins elected to run as an independent. There's no primary for independents, so he has to get on the ballot by petition...nothing wrong with that, it happens in other elections too, but for some reason, people seem to have a problem with it happening in this particular race.

Nursenat, tis true. However, I don't actually drink too often...I may want to, but I am a good girl most of the time. It does make me feel better to say it though, nice cold pina colada, or beer, or margarita, or shot of tequila. The list goes on. Don't worry though I was weened off pretty good when I got out of the Navy and had children. I just really want one or 3.

One of the mailings I received from Randy Scott mentioned Mike Rose defaulting on loans, but I haven't been able to find any details about this and am wondering if it is really true and if this happened before or after he filed his complaints against Bill Branton?
Part of the reason it doesn't add up to me is because according to the 4/09/1998 article in the P&C, Rose "said that during the campaign, he went to each bank in Summerville and asked to borrow money for his campaign, offering to put up as collateral a cash amount equal to the loan in the form of a certificate of deposit.
In every case, he said, the banks turned him down, saying it was against bank policy to loan money for a political campaign.
Since these banks would not loan him money, even with collateral in the form of a certificate of deposit, Rose said he is especially curious to know what collateral Branton put up for his loans."
If Rose already had a record of defaulting on loans, it should have been clear to him why banks turned him down.
It doesn't add up for him to have defaulted after this complaint about Branton because by then he was going around the country as a spokesman for Excel saying how much money he was making and how it had changed his life. He should have had enough not to have to default, right?
I would appreciate anyone who could give me the real facts about whether Mike Rose really defaulted on loans or not. Thanks.

Rose ran and beat Scott who had a DUI charge 6 weeks before the primary. Rose only won by 500 votes out of 11,000+. Collins simply wants to run to give the Republicans in Dorchester County another choice since Rose is not very loved by many. His reputation precedes him from litigation against businesspeople to defaulted bank loans, to calling Dorchester County people "a bunch of rednecks" for not voting for him in his failed US Congress run, to EXCELLING his way through the SC Senate .....and on and on. If you can't figure this one out, then vote for Rose. Collins has a reputation as a successful small business person. And none of the baggage. Collins gets my vote and suppport

Our two largest political parties will do anything to crush democracy. Running as an independent is the most democratic, and honest, way to run for office. The big parties fear losing power and influence. We might be better off without them!

Mr Rose mad a comment in general that he knows nothing about it but what everyone is reading in the media..
Do an archive Of Mike Rose and see how many articles were written by Terry Joyce...

Mike Rose has defaulted on a loan of many thousands of Dollers, his wife was charged ( But she was not his wife at the time she made Rose the loan at FNB, holly hill I think, she was the Loan officer and when it hit the Post and courier , He Maried her , as so she could not testify. The President at this time was Earl / Now it is Ron...... Ned some checking into......This is why Rose like to stay insides to hide. or I forgot Attorneys cant hide. They not afraid of the Big bad woof...
